Executive Placements

Our fees for Executive Placements will be a percentage of the remuneration paid during the first twelve months of the engagement and shall be charged as follows:

  • Packages up to $100,000: 16% + GST
  • Packages over $100,000: 20% + GST

The remuneration paid during the first twelve months of the engagement will include:

  • The annual salary
  • Superannuation contributions
  • A company vehicle, if applicable, as valued by the client
  • 50% of any forecasted commission or bonuses
  • Site Allowances

It will not include the following:

  • Travel Allowances
  • Relocation Assistance
  • Inducement or sign-on payments
  • Non-salary benefits such as computers, phone allowances or professional membership fees
  • The fees will be payable in the following manner and all fees are quoted excluding GST:

Retained Executive Recruitment Assignments

  • The Retainer Fee - One third of the fee (based on the anticipated total remuneration package) will be invoiced upon receiving approval to commence the assignment.
  • The Shortlisting Fee - The second third of the fee will be invoiced following the successful presentation of the shortlisted candidates. A successful presentation is defined as a shortlisted candidate being requested to attend an interview with the client.
  • The Placement Fee - The balance of the fee, based on the final negotiated package, will be invoiced upon the successful offer and acceptance of the position.

Guarantee for Retained Executive Recruitment Assignments

Candidates appointed under an Exclusive Retained Executive Recruitment Assignment agreement will carry a three month 100% money back guarantee from the date of commencement, providing that the Retainer Fee and the Shortlisting Fee have been paid within 14 days of the date of invoice, and the Placement Fee has been paid within 14 days of the date of commencement of the candidate. This is limited to the placement fee and does not extend to advertising expenses or other costs. Should a Retained Executive Recruitment Assignment be cancelled by you, then the Retainer Fee and the Shortlisting Fee (if applicable) will become immediately payable.

Contingent Executive Recruitment Assignments or Referred Candidates

The total fee will become payable within 14 days of the commencement date of the candidate.

Guarantee for Contingent Executive Recruitment Assignments or Referred Candidates

Candidates appointed under a Contingent Executive Recruitment Assignment agreement will carry a three month replacement guarantee from the date of commencement, providing that all fees have been paid within 14 days of the commencement date of the candidate. This guarantee is limited to one replacement only and relates specifically to the original position and is not transferable.

Advertising & Other Expenses

The cost of all display advertising will be charged directly to the client. Internet Advertising Campaigns, which include emailing the database, will be charged at $330 including GST per assignment. All other out-of-pocket expenses such as airfares, accommodation, etc will be passed on to the client immediately after initial approval has been obtained and will be payable within 14 days of the date of the invoice.

Acceptance of the Terms of Business

These Terms of Business will be accepted by the client in the following ways:

  • The client signing and returning this Terms of Business
  • The client confirming acceptance by email
  • The client requesting that a candidate be submitted for consideration for a position
  • The engagement of a candidate introduced by Barclay Recruitment

When Fees become payable

You are responsible for notifying Barclay Recruitment of any offer of employment that you make to a candidate introduced by us, and to notify us immediately upon the acceptance of that offer.

Should you make an offer to a candidate who has been introduced to you by Barclay Recruitment within a period of six months of that introduction, then you agree to be bound by these Terms of Business and will be liable for the appropriate fee.

This includes candidates who have been initially rejected by you, or have received an offer of employment and declined to accept, and are subsequently employed by you in any capacity. Furthermore, should a candidate be introduced to you by Barclay Recruitment and you introduce them to a third party that employs them, then the applicable fee will be payable by you.

Multiple Candidate Employment

In the case where more than one candidate is employed from the shortlist provided, then the applicable fee will become due and payable by you for the second and any subsequent candidates.

Assignment Guarantees

In relation to assignment guarantees, Barclay Recruitment must be NOTIFIED IN WRITING within seven days of the termination of the candidate and, if a refund applies, it will be paid to you within fourteen days of notification. This guarantee relates to the candidate's competence for the position to which they were appointed and does not cover circumstances that are deemed to be beyond the control of Barclay Recruitment such as; a redundancy because of a company restructure, transferring a candidate to a position that he or she was not initially recruited for, or unlikely events such as death or permanent incapacitation.

Introduction of Candidates

Should a candidate be introduced to you by Barclay Recruitment, and you have knowledge of that candidates' existence, or have a record of the candidate on an internal database, or have had the candidate apply directly to you greater than 30 days prior to our introduction, or have contact with that candidate via Linked In or Facebook or any other similar networking site, and you have not contacted the candidate specifically in regard to the position to be filled, then you agree that our introduction of the candidate has been accepted and if the candidate is subsequently employed, our fee will be payable. In the situation where the candidate has applied directly to you for the specific assignment prior to our submission of them, and written proof of that application is provided to Barclay Recruitment, then no fee will be payable if that candidate is subsequently employed for that assignment by you.

Candidate Suitability and References

Our objective is to identify suitable candidates and provide accurate details for them. However, this is substantially based on information supplied to us by the candidates and, as such, no responsibility can be accepted for errors or omissions or for incorrect conclusions. It is you, the client, who will make the final recruitment decision. Therefore, throughout the process you must ensure that you satisfy yourself as to their competence, qualifications, integrity and suitability for the position. Barclay Recruitment cannot accept liability, either personal or corporate, for compensation for any loss or damage, howsoever arising, which you may suffer or become liable for as a result of our introduction of a candidate and your decision to employ that candidate. The offer to employ the candidate, the employment of the candidate, and the consequences thereof following the introduction of the candidate by you to a third party is entirely at your own risk.

Barclay Recruitment will endeavor to ensure the suitability of the candidate for the position by obtaining a minimum of two reference checks for the candidate and providing these to you in writing along with the contact details of the referee. You are responsible for deciding the suitability of the candidate by accepting the references provided by the candidate or Barclay Recruitment. Should you decide to conduct your own reference checks then you must provide Barclay Recruitment with written confirmation of this. We will still conduct a minimum of one reference check for our purposes of ascertaining the suitability of the candidate for the position.

You will be solely responsible for organising medical examinations if you so desire, and be the sole decision maker as to whether or not the candidate meets the requirements for the position. You will also be solely responsible for confirming that any qualifications, professional associations, or work permits required by you, or by law, are held by the candidate.

Finally, candidates' details are highly sensitive and are supplied to your organisation on a strictly confidential basis and may not be disclosed to a third party without the approval of either the candidate or Barclay Recruitment.
